Terms of Service

By accessing or using World of the Cup (“the Service”, “we”, “us”, “our”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. Use of the Service constitutes your acknowledgment that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access or use the Service. You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18 years of age, you may use the Service only with the permission of a parent or legal guardian. The Service is not directed to children under 13, and users under 13 may not access or use the Service.

World of the Cup is an independent fan product that provides AI-powered personalized trading card generation for football fans. For a one-time fee, users receive a single AI-generated digital trading card image based on information and an optional photo submitted through the Service. World of the Cup is not affiliated with, endorsed by, or connected to FIFA, the Fédération Internationale de Football Association, any national football association, any official World Cup 2026 commercial programme, EA Sports, or any other official football governing body or commercial entity. All team names, nation names, and football references are used for fan identification purposes only.

All payments are processed securely through Stripe. By completing a purchase you authorize a one-time charge to your payment method. Due to the AI-generated and immediately delivered nature of this digital product, all sales are generally final. Card generation times may vary depending on system demand and are not guaranteed.

Technical failures. If your card fails to generate due to a technical error on our end, we will make it right. Contact us at legal@worldofthecup.com within 48 hours of purchase with reasonable evidence of non-delivery — such as a screenshot of an error message, your purchase confirmation email, or a description of what occurred and when. Once we verify the issue, we will deliver your card to you directly via email. We reserve the right to request additional information to verify the claim before taking action.

Content rejections.If your submitted photo is rejected by our content moderation system before generation begins, you will receive a full automatic refund. Refunds will appear on your statement within 5–10 business days depending on your financial institution. If a card is generated but subsequently removed due to a policy violation identified after delivery, no refund will be issued. You are responsible for ensuring that any content you submit complies with these Terms before purchase.

Fan Wall removal. If we determine, at our sole discretion, that a card on the Fan Wall contains inappropriate, offensive, or policy-violating content — even if that content passed our automated moderation systems at the time of generation — we reserve the right to remove it from the Fan Wall at any time without prior notice. No refund will be issued in connection with Fan Wall removal. Purchase of a card does not guarantee permanent or uninterrupted Fan Wall placement.

By submitting any content including photos, text, or other materials through the Service, you represent, warrant, and agree that:

• You are the sole subject of any photo you submit, or you have obtained explicit written permission from every identifiable person appearing in any photo you submit to use their likeness for this purpose.
• You own all rights to any content you submit, or have obtained all necessary rights, licenses, consents, and permissions to submit such content and grant us the rights described in these Terms.
• Your submitted content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or any other rights.
• Your submitted content is not and will not be defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise in violation of any applicable law or regulation.
• If you are under 18, you may submit only your own photo and only with the permission of a parent or legal guardian. You may not submit photos of any other minor. If you are 18 or older, you may submit a photo of yourself or a minor only if you are the minor's parent or legal guardian, or you have obtained all necessary permission from the minor's parent or legal guardian.

You acknowledge that while we implement automated content moderation tools, we do not manually review every submission and cannot guarantee that all submitted content meets these requirements. You accept full and sole responsibility for any content you submit.

We reserve the right, but assume no obligation, to refuse to process, remove, or decline any submission that in our sole discretion violates these Terms or is otherwise objectionable. We reserve the right to refuse service to any user for any reason at any time. Automated content moderation tools are used to screen submitted images but are not infallible. The presence or absence of automated moderation does not constitute our endorsement or approval of any submitted content.

In the event that an offensive, inappropriate, or otherwise objectionable image passes through our automated content moderation systems, administrators of World of the Cup reserve the right to remove any card — including from the Fan Wall and any publicly visible area of the Service — at any time, for any reason or no reason, without prior notice and without issuing a refund. This right applies regardless of whether the card was previously approved by automated systems. Our failure to remove content promptly does not constitute a waiver of this right.

Subject to your compliance with these Terms, upon successful delivery of your card, we grant you a limited, non-exclusive, non-transferable license to use the generated card image for personal, non-commercial purposes, including sharing your card on personal social media and other personal platforms. You may not resell, sublicense, mint as an NFT, use in merchandise, use in paid advertising, or otherwise exploit the card for commercial purposes without our prior written consent. World of the Cup retains all rights in the Service, including the card design framework, prompt engineering methodology, and the overall system and process used to generate cards. The underlying AI image generation is powered by third party providers including OpenAI. While we do not claim ownership of third party AI models, our specific implementation, card design process, prompt structure, and methodology are our proprietary work product.

The Service uses third party artificial intelligence models to generate card images. You acknowledge and agree that:

• AI-generated outputs are inherently unpredictable and variable. Even when your submitted content is entirely appropriate and compliant with these Terms, the AI may produce outputs that are unexpected, inaccurate, or unintended.
• AI-generated images may occasionally and unintentionally resemble real people, existing artworks, logos, characters, or other protected content. World of the Cup does not intentionally direct the AI to reproduce any copyrighted or protected material, but cannot guarantee that AI outputs will never bear resemblance to such material due to the nature of how AI models are trained.
• World of the Cup is not liable for any AI-generated output that unintentionally resembles, references, or could be construed as infringing upon any third party's intellectual property, likeness, or other rights. Any such resemblance is entirely unintentional and a result of the inherent randomness of AI generation.
• You accept the AI-generated card as-is and acknowledge that variations in quality, style, likeness accuracy, and content are a fundamental characteristic of AI-generated products and do not constitute grounds for a refund outside the circumstances described in Section 3.
• World of the Cup disclaims all liability for any third party claims arising from the unintentional content of AI-generated outputs where such content was not deliberately prompted by us.

We do not intentionally generate or authorize infringing, misleading, or unlawful content. If you believe a generated card violates your rights or the rights of another person, contact us at legal@worldofthecup.com and we will review the issue and, where appropriate, remove or disable access to the content.

The Service relies on third-party providers for payment processing, hosting, database storage, email delivery, content moderation, and AI image generation. These providers may include Stripe, Supabase, Resend, OpenAI, and other service providers we use to operate the Service. We are not responsible for delays, outages, moderation decisions, refusals, processing failures, or limitations caused by third-party providers. A generation may fail or be rejected if submitted content violates these Terms, our policies, or the policies of our third-party providers.

Participation in the Fan Wall is entirely voluntary and requires your explicit opt-in. By opting in to the Fan Wall, you grant World of the Cup a non-exclusive, royalty-free, worldwide license to display your card publicly on the Fan Wall pages of this website for the duration of the 2026 World Cup and the end-of-tournament email.

If a card depicts a minor, the person opting in to the Fan Wall represents and warrants that they are the minor depicted, the minor's parent or legal guardian, or that they have obtained all necessary permission from the minor's parent or legal guardian.

Public Fan Wall content may be viewed, copied, screenshotted, downloaded, indexed, or shared by others. You may request removal of your card from the Fan Wall at any time by contacting us at legal@worldofthecup.com. Removal will be completed within 72 hours of your request. Removal from our website does not guarantee removal of copies, screenshots, cached pages, reposts, or other third-party uses outside our control.

You agree not to use the Service to:

• Generate content that is sexually explicit, pornographic, or sexually suggestive.
• Generate content that depicts, promotes, or glorifies violence, hatred, or discrimination against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
• Generate content that harasses, threatens, or intimidates any individual.
• Circumvent, disable, or interfere with security-related features of the Service.
• Use automated tools, bots, or scripts to access the Service.
• Attempt to reverse engineer, decompile, or extract the underlying prompts or systems of the Service.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR QUALITY OF ANY AI-GENERATED CONTENT. AI-GENERATED IMAGES ARE INHERENTLY VARIABLE AND UNPREDICTABLE AND WE MAKE NO GUARANTEES REGARDING THE SPECIFIC APPEARANCE, LIKENESS ACCURACY, CONTENT, OR QUALITY OF ANY GENERATED CARD. WE SPECIFICALLY DISCLAIM ANY LIABILITY FOR UNINTENTIONAL CONTENT PRODUCED BY AI GENERATION SYSTEMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WORLD OF THE CUP AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE 30 DAYS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless World of the Cup and its owners, officers, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: your use of the Service; your violation of these Terms; your violation of any third party rights including privacy rights, publicity rights, or intellectual property rights; any content you submit through the Service; or your violation of any applicable laws or regulations. This indemnification obligation will survive termination of these Terms and your use of the Service.

You acknowledge and agree that you are solely and entirely responsible for all content you submit through the Service. World of the Cup acts solely as a conduit for user-submitted content and is not responsible for screening, reviewing, or approving user submissions beyond automated moderation tools. By submitting content you accept full legal and moral responsibility for that content and agree to indemnify World of the Cup against any claims arising from your submitted content as described in Section 13.

We respect intellectual property rights. If you believe any content on the Service infringes your copyright, please send a notice to legal@worldofthecup.com including: a description of the copyrighted work; the URL where the infringing content appears; your contact information; a statement that you have a good faith belief the use is unauthorized; and a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf. We will respond to valid notices promptly.

We may terminate, restrict, or refuse service to users who repeatedly submit infringing content, violate third-party rights, abuse the Service, or violate these Terms.

Your use of the Service is also governed by our Privacy Policy. By using the Service you consent to the collection and use of your information as described in the Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively through binding individual arbitration under the American Arbitration Association rules, not in court. You waive any right to participate in class action lawsuits or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date at the top of these Terms. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

These Terms constitute the entire agreement between you and World of the Cup regarding the Service and supersede all prior agreements and understandings, whether written or oral, relating to the Service.
